RETURN & CANCELLATION POLICY
Service Refunds
For Clearwire service purchased and activated directly through clear.com or clearprofessional.com (or another authorized Clearwire retail sales channel), Clearwire provides you, on a one (1)-time only basis, with a fifteen (15) day service return policy with respect solely to your initially ordered Clearwire service period, provided that such initially ordered Clearwire service is in the form of a monthly rate plan, and provided further, if your monthly rate plan contains a monthly data allowance, that such data allowance has not been fully used up. (This service return policy does not apply if the initial Clearwire service that you order is in the form of (i) a two (2)-hour, daily or weekly rate plan or (ii) any other rate plan of a time increment other than monthly.) If for any reason you are not completely satisfied with such initially ordered Clearwire monthly service and you consequently elect (by calling Clearwire Customer Care at (or at if you are a CLEAR Professional Service subscriber), or by visiting the retail location where you originally purchased your Clearwire service) to cancel such Clearwire service, then you may obtain a refund (which refund may be in the form of a VISA® Gift Card or other similar instrument, the redemption and use of which Card or instrument shall be governed by the terms, conditions and restrictions set forth or referenced on such Card or instrument) of the service fee (including any applicable taxes thereon) that you previously paid for such initial monthly service period, provided that you call Clearwire Customer Care or visit such retail location during the following applicable period: (A) if your monthly rate plan does not contain a monthly data allowance, then within fifteen (15) days after the start of your initial monthly service period; or (B) if your monthly rate plan contains a monthly data allowance, then by that point in time which is both prior to your using up that full data allowance and within fifteen (15) days after the start of your initial monthly service period.
Device Refunds
Clearwire additionally provides you with a thirty (30)-day device return policy on a device purchased directly through clear.com or clearprofessional.com (or Clearwire Telesales or a Clearwire-operated retail store/kiosk). If for any reason you are not completely satisfied with your Clearwire device and you consequently elect to return it within thirty (30) days after the date on which you purchased your Clearwire device from Clearwire, then provided that you return your purchased device (in undamaged condition and in good working order, and together with your original device purchase receipt or other device proof of purchase) within thirty (30) days from your cancellation date (the “Device Return Requirement”), you will receive a refund (which refund may be in the form of a VISA® Gift Card or other similar instrument, the redemption and use of which Card or instrument shall be governed by the terms, conditions and restrictions set forth or referenced on such Card or instrument) of your purchase price (including taxes, but excluding shipping and rebate amounts) for such device; provided, however, that if you are a CLEAR Professional Service subscriber and you fail to fulfill the Device Return Requirement, then you shall owe to Clearwire, and Clearwire thereupon shall be entitled to charge and collect from you, a “Device Non-Return Fee” in the amount of the then fair market value of your non-returned device. You may return your purchased device by calling Clearwire Customer Care (at , or at if you are a CLEAR Professional Service subscriber), who will either (a) email you a prepaid mailing label, or (b) direct you to a nearby Clearwire retail location, in order to return the device. If you return such device in damaged condition or in poor working order as the sole result of a manufacturer’s defect, then that fact in itself will not disqualify you from receiving a refund of your device purchase price, provided that you otherwise satisfy each of the requirements set forth in this paragraph. Please note that if you purchased your device from a Clearwire authorized agent (rather than from Clearwire itself), then your ability to return the device (and to receive any refund amount) shall be governed by that agent’s return policy, and you should please call the agent or visit your place of purchase in order to learn the complete details of the agent’s device return policy.
The above-described device return policy and service return policy do not diminish your responsibility for the payment of any and all other taxes and charges (e.g., any applicable shipping fees; if you are a CLEAR Professional Service subscriber, any professional installation fees) that you may have incurred through the date of your Clearwire service cancellation.
